On order of the Court, the motions for immediate consideration and the motion to permit foreign attorney to appear and practice as co-counsel for plaintiff-appellee are considered, and they are GRANTED. The applications for leave to appeal from the October 4, 2002 decision of the Court of Appeals are also considered, and they are GRANTED.

The motions by the Michigan Manufacturers Association and the Michigan Aggregates Association for leave to file briefs amicus curiae are considered, and they are GRANTED. The Associations are also GRANTED leave to file a brief amicus curiae in the appeal.
