On March 17, 2023, the Commissioner filed a motion to dismiss or lack of jurisdiction and supplemented his motion on May 26, 2023.

This case was called from the calendar of the Court's Cincinnati, Ohio trial session on September 11, 2023. During calendar call, there was no appearance by or on behalf of the petitioner, Frank A. Prastine, Jr. Counsel for the Commissioner appeared and was heard. We set this case to be recalled the next day.

This case was recalled from the calendar on September 12, 2023, for hearing on the pending motion in this case. Both parties appeared and were heard. Upon due consideration and for cause more fully appearing in the transcripts of the proceedings, it is

ORDERED that the Commissioner's motion to dismiss for lack of jurisdiction, as supplemented, is taken under advisement. It is further

ORDERED that, on or before October 12, 2023, the Commissioner shall file a status report with the Court as to the then-present status of this case.
