Power v. Wagner

Appellate Division of the Supreme Court of New York, Second Department
Jun 1, 1914
163 App. Div. 966 (N.Y. App. Div. 1914)

Opinion

June, 1914.

We think the proofs taken on the trial do not support the judgment. In view of the unusual situation presented by this case, we deem it in the interests of justice to grant a new trial. Judgment reversed and new trial granted, costs to abide the final award of costs. Jenks, P.J., Burr, Carr, Stapleton and Putnam, JJ., concurred.
