Frank C. Powell and Evans and Powell, PLLC v. Kevin Fletcher and Steven Fletcher

257th District Court of Harris County Trial court case number: 2018-67151

ORDER

PETER KELLY, JUDGE

Appellants' brief was originally due on April 10, 2023. After a late brief notice issued, appellants did not file a motion for extension until June 30, 2023, which requested an extension until August 31, 2023. The Court granted this extension. No brief was filed. Appellants filed a second motion for extension on September 8, 2023, which the Court granted until October 9, 2023, stating that no further extensions would be granted absent a showing of extraordinary circumstances. No brief was filed. Appellants filed a third request for extension on October 6, 2023, which the Court granted until November 8, 2023, again stating that no further extensions would be granted absent a showing of extraordinary circumstances. No brief was filed. On November 6, 2023, appellants filed a fourth motion for extension, which the Court granted until December 8, 2023, warning that no further extensions would be granted. No brief was filed.

On December 6, 2023, appellants requested a fifth extension claiming good cause existed because counsel had been attending to other matters and some unidentified items were missing from the record. Appellants request an additional 30 days, "until December 15, 2023." Appellants brief was originally due on April 10, 2023, and thus, appellants have had ample time to review the record and file the brief and have not done so. The Court warned appellants when granting the last motion for extension that no further extensions would be granted.

Appellants' motion for extension of time to file appellants' brief is denied. Appellants' brief shall be filed within 10 days from the date of this order or the appeal will be dismissed.

It is so ORDERED.
