Present — Martin, P.J., O'Malley, Townley, Cohn and Callahan, JJ.; Townley and Cohn, JJ., dissent and vote to reverse and deny the motion on the ground that the parties are living in the same abode at the present time.


Order affirmed, with twenty dollars costs and disbursements, on the ground that the circumstances warrant the granting of a counsel fee.
