DECISION & ORDER ON MOTION

Motion by Nathan M. Ferst for leave to withdraw as counsel for the appellant on appeals from an order of the Supreme Court, Nassau County, entered January 28, 2011, and a judgment of the same court entered February 25, 2011. Application by the appellant pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect the appeals.

Upon the papers filed in support of the motion and the application, and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied as unnecessary as new counsel has appeared for the appellant and has perfected the appeals; and it is further,

ORDERED that the application is denied as academic as the appeals were timely perfected on September 16, 2011.
