Porter v. Berkshire Court, Inc.

Appellate Division of the Supreme Court of New York, Second Department
Jul 1, 1927
221 App. Div. 805 (N.Y. App. Div. 1927)

Opinion

July, 1927.

Present — Kelly, P.J., Young, Kapper, Lazansky and Hagarty, JJ.

Judgment unanimously affirmed, with costs. The assignment of the stock did not assign any right under the agreement. We are also of opinion that the right to lease an apartment, given by the agreement, was personal to plaintiff's assignor, and was not assignable.
