Porro v. Porro

District Court of Appeal of Florida, Fourth District
Dec 19, 1986
498 So. 2d 1065 (Fla. Dist. Ct. App. 1986)

Opinion

No. 4-86-2413.

December 19, 1986.

Appeal from a non-final order of the Circuit Court for Palm Beach County; John D. Wessel, Judge.

Gregory S. Burdick, Edna L. Caruso and Philip Burlington of Edna L. Caruso, P.A., West Palm Beach, for appellant.

Timothy P. McCarthy of Merola, McCarthy Cox, P.A., Palm Beach Gardens, for appellee.

We reverse the finding of contempt because we believe the appellant was entitled to testify on her own behalf at the contempt hearing. Our reversal, of course, is without prejudice to the continuation of this contempt proceeding or any other proceedings to support the court's orders concerning child custody and visitation.

ANSTEAD, LETTS and GLICKSTEIN, JJ., concur.
