Pope v. State of New York

Appellate Division of the Supreme Court of New York, Fourth Department
Mar 19, 1954
283 App. Div. 853 (N.Y. App. Div. 1954)

Opinion

March 19, 1954.

Present — McCurn, P.J., Vaughan, Kimball, Piper and Wheeler, JJ.

Judgment affirmed, without costs of this appeal to either party. All concur, except McCurn, P.J., who dissents as to that part of the judgment which denies an award for conscious pain and suffering and votes to grant a new trial on the ground that the findings as to that cause of action are against the weight of evidence.
