Summary Dispositions January 31, 1997:

In lieu of granting leave to appeal, the March 26, 1996, order of the Court of Appeals is vacated, and the case is remanded to that Court for reconsideration of plaintiff's complaint for superintending control. MCR 7.302(F)(1). Contrary to the Court of Appeals statement in its order, the Recorder's Court docket entries in this case reflect that plaintiff did file with that court a motion for relief from judgment. Jurisdiction is not retained.
