Plunkett v. Conn. Gen. Life Ins.

Court of Appeals of Texas, Fifth District, Dallas
Sep 9, 2004
No. 05-04-01013-CV (Tex. App. Sep. 9, 2004)

Opinion

No. 05-04-01013-CV

Opinion issued September 9, 2004.

On Appeal from the 68th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 02-11776-C.

Dismissed.

Before Chief Justice THOMAS and Justices LANG-MIERS and MAZZANT.

MEMORANDUM OPINION

On July 30, 2004, appellants filed a docketing statement with this Court. In the docketing statement, appellants acknowledged that there was a question about this Court's jurisdiction. On August 6, 2004, we requested that appellants and appellees file letter briefs explaining how this Court has jurisdiction over this appeal. Appellants timely filed a letter brief, and appellees responded thereto. All parties concede that this Court does not have jurisdiction over this appeal because the order being appealed does not dispose of all parties and claims and, consequently, is not final and appealable. See Lehmann v. Har-Con Corp., 39 S.W.3d 191, 195 (Tex. 2001). We agree.

Therefore, on the Court's own motion, this appeal is DISMISSED for want of jurisdiction. See Tex.R.App.P. 42.3(a).
