MAURICE LAMAR PIPER, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 283rd Judicial District Court Dallas County, Texas
Trial Court Cause No. F15-75812-T

ORDER

We REINSTATE this appeal.

On June 20, 2017, we abated this appeal for a hearing. On August 4, 2017, a supplemental reporter's record containing the State's exhibit 36 was filed. On August 11, 2017, the supplemental clerk's record containing the trial court's July 27, 2017, findings was filed. We ADOPT the trial court's findings that: (1) appellant timely requested the reporter's record; (2) State's exhibits 32 and 46 have been lost or destroyed through no fault of appellant, but State's exhibit 36 has been recovered; (3) State's exhibits 32 and 46 cannot be replaced by agreement or by copies that duplicate the original exhibits; and (4) State's exhibits 32 and 46 are cumulative of other exhibits that are in the record and not necessary to the resolution of the appeal of this case.

We ORDER appellant's brief due within THIRTY DAYS of the date of this order.
