ORDER

Taking into account the representations contained in respondent's Motion to Dismiss on Ground of Mootness and to Strike as to Petitioner's 2009 Income Tax Liability, filed August 21, 2023, and the statements made by respondent's counsel is support of the motion when the motion was heard in Atlanta, Georgia, on September 11, 2023, it is

ORDERED that the motion is granted. It is further

ORDERED that so much of this case as relates to 2009 is dismissed as moot. It is further

ORDERED that on the Court's motion, this case is continued with jurisdiction retrained by the undersigned.

The parties are advised that unless a proposed stipulated decision is submitted sooner, the case will be set for trial during the Court's 2024 winter term.
