Judgment and order reversed and new trial granted, with costs to appellant to abide event unless plaintiff stipulates to reduce the verdict to $4,000, in which case judgment is modified accordingly and as so modified judgment and order affirmed, without costs. All concurred, except Betts, J., who voted for affirmance.
