JOINT STIPULATION TO DISMISSAL OF WRIT OF HABEAS CORPUS UNDER 28 U.S.C. § 2241 WITHOUT PREJUDICE.


Petitioner, by and through his attorney of record, and Respondents, by and through their attorneys of record, hereby stipulate, subject to the approval of the Court, as follows:

1. A Writ of Habeas Corpus in the above-entitled case was filed on December 20, 2002, with the United States District Court.

2. Petitioner was ordered removed from the United States on November 28, 2002 by the Immigration Judge. He has now been physically removed from the United States by the Immigration and Naturalization Service.

3. In light of Petitioner's removal from the United States, the parties agree to a dismissal of the Writ of Habeas Corpus without prejudice.

IT IS SO STIPULATED.

ORDER

Petitioner's Writ of Habeas Corpus is hereby dismissed without prejudice.

IT IS SO ORDERED.
