ORDER TRANSFERRING VENUE TO THE DISTRICT OF ARIZONA AND DENYING MOTION TO DISMISS AS MOOT


By order dated February 24, 2003, this Court found that plaintiff had not alleged facts sufficient to establish personal jurisdiction over defendants in the Northern District of California. The Court gave plaintiff twenty days leave to amend its complaint, to augment its jurisdictional allegations, and further ordered that if plaintiff chose not to amend, the Court would grant defendant's motion to transfer venue to the District of Arizona and deny defendant's motion to dismiss as moot.

Plaintiff has chosen not to amend. Accordingly, IT IS HEREBY ORDERED that venue of this action is transferred to the District of Arizona, and defendants' motion to dismiss is DENIED as moot. All scheduled dates in this District are vacated.

IT IS SO ORDERED.
