352 So. 2d 73 (Fla. Dist. Ct. App. 1977)

Opinion

No. 76-76.

May 27, 1977.

Appeal from Circuit Court, Orange County; W. Rogers Turner, Judge.

Richard L. Jorandby, Public Defender, Frank B. Kessler, Asst. Public Defender, and James K. Green, Legal Intern, West Palm Beach, for appellant.

Robert L. Shevin, Atty. Gen., Tallahassee, and Marsha G. Madorsky, Asst. Atty. Gen., West Palm Beach, for appellee.

AFFIRMED.

DOWNEY, J., and GREEN, OLIVER L., Associate Judge, concur.

ALDERMAN, J., dissents, with opinion.

In my opinion the evidence in this case is sufficient only to support a conviction under Section 794.011(5), Florida Statutes (1974 Supplement to Florida Statutes 1973). I would remand with instructions that the defendant be sentenced for a felony of the second degree.
