ORDER DISMISSING APPEAL

Upon review of the record, it appears that (1) this court informed Appellant Gerald J. Peterson by letter dated April 12, 2001 that the time for filing the statement of jurisdiction expired on March 31, 2001; (2) by letter dated May 21, 2001, this court informed appellant that the time for filing the opening brief expired on April 30, 2001 and that, pursuant to Rule 30 of the Hawaii Rules of Appellate Procedure, the matter would be called to the attention of the court for such action as the court deemed proper including dismissal of the appeal; (3) appellant has failed to file the statement of jurisdiction; and (4) appellant has failed to respond to the said May 21, 2001 letter or to otherwise oppose dismissal; therefore,

IT IS HEREBY ORDERED that the appeal is dismissed.
