BUILDINGS AND BUILDING RESTRICTIONS, § 40 — questions for jury in action for death as result of fall down tavern's basement stairway. In action for death of 54-year-old woman who was killed by falling down basement stairway in defendants' tavern, whether defendants were negligent and whether woman was exercising due care for her own safety were for jury under evidence that woman had been using public telephone located in small booth or room having two doors, one of which lead to stairway, and that bartender had been to basement shortly before accident.
