Peterson v. Giffin

District Court of Appeal of Florida, Fourth District
Sep 27, 1990
566 So. 2d 335 (Fla. Dist. Ct. App. 1990)

Opinion

No. 89-1287.

August 29, 1990. Rehearing Denied September 27, 1990.

Appeal from the Circuit Court for Palm Beach County; Richard Burk, Judge.

John L. Avery, Jr. of Law Offices of John L. Avery, Jr., Jupiter, for appellants.

Jeffrey A. Paine of Law Offices of Jeffrey A. Paine, P.A., West Palm Beach, for appellees.

We affirm a judgment of involuntary dismissal entered at the conclusion of plaintiffs' case in a non-jury trial. A review of the record reflects a failure to prove a prima facie case for breach of contract without reference to excluded evidence.

LETTS, DELL and STONE, JJ., concur.
