Upon due consideration of respondent's Motion to Dismiss for Failure to State a Claim upon Which Relief Can Be Granted filed July 14, 2023, and the record of this case, it is

ORDERED that petitioner shall, on or before August 9, 2023, file a proper amended petition in compliance with the Tax Court Rules of Practice and Procedure. Failure to comply with this Order may result in the granting of respondent's motion. It is further

ORDERED that the Clerk of the Court shall attach to the copy of this Order served on petitioner a form which may be used to file a proper amended petition.

Respondent's motion shall be held in abeyance.
