Appellant, Raymond Trent Peterek, attempted to perfect an appeal from a final decree of divorce entered by the County Court of Aransas County, Texas, in cause number A-15-7029-FL. We dismissed the appeal for want of jurisdiction on grounds that the appeal was untimely. Appellant has filed a motion for rehearing alleging that dates for the final judgment, the mailing of the final judgment, and the mailing of the motion for new trial were not properly before the Court at the time it dismissed the case.
Accordingly, this appeal is ABATED and REMANDED to the trial court for proceedings in accordance with Texas Rule of Civil Procedure 306a and the matters raised in appellant's motion for rehearing. See TEX. R. CIV. P. 306a(4),(5). The trial court is directed to forward a supplemental clerk's record, including any orders rendered, and a supplemental reporter's record, if such is necessary, to this Court within thirty (30) days of the date of this order, or to notify this Court within such period indicating a date by which the trial court can comply. Appellant's motion for rehearing is CARRIED WITH THE CASE pending the trial court findings on this matter.
