MEMORANDUM OPINION


Before the Court is the parties' September 3, 2003 agreed motion to dismiss. The parties state that they have "compromised and settled all claims against each other and a Compromise Settlement and Mutual Release Agreement has been executed by the parties." Appellant states that he no longer wishes to pursue the appeal. The parties agree to bear their own costs, including attorneys' fees.

We GRANT the agreed motion and this appeal is DISMISSED. See Tex.R.App.P. 42.1(a).
