       Reversed. Carroll v. OSP, 33 Or.App. 83, 575 P.2d 173 (1978).

Our disposition of this case should not be construed as preventing respondent from charging an inmate on facts such as those present here with a violation of OAR 290-40-050(5), Unauthorized Possession of Property.
