Defendant having moved for permission to file an incomplete CPL 460.15 application seeking permission to appeal the order of Cayuga County Court dated November 20, 2013, and for other relief,

Now, upon reading and filing the statements of Ricky Lee Winters dated February 9, 2014 and January 30, 2014, and the affidavit of Brian N. Bauersfeld, Esq. sworn to February 26, 2014, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is denied.

Memorandum: An application submitted pursuant to CPL 450.15 must contain all papers submitted to the court that entered the order sought to be reviewed (see 22 NYCRR 1000.13 [o]).
