An appeal having been taken from an order of the Supreme Court, New York County, entered on or about June 22, 2010, which denied defendant's motion for resentencing pursuant to the Drug Law Reform Act of 2009; and assigned counsel having moved to withdraw the appeal as moot on the ground that it has been superseded by an order, same Court, entered on or about September 12, 2017, Now, upon reading and filing the papers submitted on the motion, and due deliberation having been had thereon, It is ordered that motion is granted to the extent that the appeal from the aforesaid June 22, 2010 order is deemed withdrawn.
