On order of the Court, the application for leave to appeal from the February 15, 2002 decision of the Court of Appeals and the motion for immediate consideration are considered. The motion for immediate consideration is GRANTED. Pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we VACATE the Wayne Circuit Court's order granting a new trial and REMAND this case to that court for reconsideration of defendant's motion for relief from judgment. On reconsideration, the Wayne Circuit Court shall apply the standards set forth in MCR 6.508(D) in rendering its decision on defendant's motion for relief from judgment.

We do not retain jurisdiction.
