An order of this Court having been entered on April 14, 2016 (M-1435) granting defendant leave to prosecute, as a poor person, the appeal taken from the judgment of the Supreme Court, New York County, rendered on or about December 4, 2015, and assigning Richard M. Greenberg, Esq., Office of the Appellate Defender, as counsel to prosecute the appeal, And a motion having been made to grant defendant leave to prosecute as a poor person, the appeal taken from a judgment of resentence of the Supreme Court, New York County, rendered on or about September 19, 2018, and for related relief, Now, upon reading and filing the correspondence from counsel for defendant-appellant dated October 26, 2018, and the undated letter from defendant-appellant with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is deemed withdrawn.
