ORDER MODIFYING OPINION AND DENYING REHEARING

THE COURT:

It is ordered that the opinion filed herein on May 6, 2011, be modified as follows:

1. On page 2, line 4 of footnote 3, the words “eight months” are deleted so that the sentence reads:

He was sentenced to three years in state prison.

2. On page 31, second sentence of the “DISPOSITION, ” the words “eight months” are deleted so that the sentence reads:

The trial court shall reduce appellant’s parole term by the number of days that his properly calculated presentence custody and conduct credits exceed the three year prison term to which he was sentenced.

There is no change in the judgment.

Respondent’s petition for rehearing is denied.
