People v. Warden, Nassau County Corr. C

Appellate Division of the Supreme Court of New York, Second Department
Sep 14, 1998
253 A.D.2d 778 (N.Y. App. Div. 1998)

Opinion

September 14, 1998

Writ of habeas corpus in the nature of an application for bail reduction upon Nassau County Indictment No. 17135/98.

Adjudged that the writ is dismissed, without costs or disbursements.

The determination of the Supreme Court, Nassau County, was not an improvident exercise of discretion, and did not violate "constitutional or statutory standards" ( People ex rel. Klein v. Krueger, 25 N.Y.2d 497, 499; see, People ex rel. Rosenthal v. Wolfson, 48 N.Y.2d 230).

Pizzuto, J. P., Joy, Florio and Luciano, JJ., concur.
