People v. Walton

Appellate Term of the Supreme Court of New York, Second Department
Jun 7, 2005
2005 N.Y. Slip Op. 50872 (N.Y. App. Term 2005)

Opinion

2004-88 W CR.

Decided June 7, 2005.

Appeal by defendant from a judgment of the Yonkers City Court, Westchester County (T. Daly, J.), rendered May 12, 2003, convicting him of speeding (Vehicle and Traffic Law § 1180 [d]) and imposing sentence.

Judgment of conviction unanimously affirmed.

Before: PRESENT: RUDOLPH, P.J., ANGIOLILLO and COVELLO, JJ.

Viewing the evidence in the light most favorable to the People ( see People v. Contes, 60 NY2d 620), we find that it was legally sufficient to establish defendant's guilt beyond a reasonable doubt. Moreover, upon the exercise of our factual review power, we are satisfied that the verdict of guilty was not against the weight of the evidence ( see CPL 470.15; People v. Olsen, 22 NY2d 230).
