ORDER

By order of March 30, 2022, the application for leave to appeal the December 22, 2021 order of the Court of Appeals was held in abeyance pending the decisions in People v Peeler (Docket No. 163667) and People v Lyon (Docket No. 164191). On order of the Court, the cases having been decided on June 28, 2022, ____ Mich. ____ (2022), the application is again considered. Pursuant to MCR 7.305(H)(1), in lieu of granting leave to appeal, we REVERSE the October 4, 2021 order of the Genesee Circuit Court denying the defendant's motion to remand for a preliminary examination, for the reasons stated in Peeler, and we REMAND this case to the circuit court for further proceedings not inconsistent with Peeler.
