People v. Tunison

Appellate Division of the Supreme Court of New York, Second Department
Jun 19, 1967
28 A.D.2d 713 (N.Y. App. Div. 1967)

Opinion

June 19, 1967

Judgment of the County Court, Dutchess County, rendered November 30, 1966, affirmed. The evidence procured by a search of defendant's person and automobile was obtained in the course of a search authorized by a warrant which had been lawfully issued upon probable cause by a Judge of the County Court, Dutchess County ( United States v. Ventresca, 380 U.S. 102; Jones v. United States, 362 U.S. 257). The search itself did not violate defendant's constitutional rights ( People v. Montanaro, 34 Misc.2d 624, 628, 629). The sentence imposed was not excessive (Code Crim. Pro., § 543, subd. 1). Beldock, P.J., Christ, Rabin, Benjamin and Munder, JJ., concur.
