On order of the Court, the delayed application for leave to appeal from the July 26, 1999 decision of the Court of Appeals and the motion to hold the application in abeyance are considered. The delayed application for leave to appeal is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court. The motion to hold the application in abeyance is also DENIED.

Court of Appeals No. 215989.

CAVANAGH and KELLY, JJ.

We would hold this case in abeyance pending the decision in People v. Bulger, (No. 112694).
