Order granting respondent's motion to dismiss the first cause of action set forth in the amended complaint affirmed, with ten dollars costs and disbursements, with leave to respondent to answer within ten days from the entry of the order herein. No opinion. Lazansky, P.J., Young, Kapper, Tompkins and Davis, JJ., concur. [ 148 Misc. 559.]
