Summary Dispositions May 27, 1998:

In lieu of granting leave to appeal, the case is remanded to the Van Buren Circuit Court. MCR 7.302(F)(1). If forfeiture proceedings have not been conducted, the record being silent on this point, the defendant is entitled to an evidentiary hearing on his claim that he has a right to the return of the sum of $727 allegedly seized by the police during a search of the defendant following his arrest. In all other respects leave to appeal is denied. Jurisdiction is not retained.
