PEOPLE v. THOMAS.


The dismissal of defendants appeal on November 30, 2004, by the Court of Appeal, Second Appellate District, Division Five, is hereby vacated. The above-entitled matter is transferred to the Court of Appeal, Second Appellate District, Division Five, with directions to reinstate the appeal and to deem the notice of appeal as having been properly filed pursuant to rule 30(b)(4)(B) with respect to those issues not requiring a certificate of probable cause (Pen.Code § 1237.5, subd. (b); rule 30(b)(1).).

BROWN, J., was absent and did not participate.

GEORGE, C.J., KENNARD, WERDEGAR, CHIN, and MORENO, JJ, concur.
