ORDER MODIFYING OPINION ON REHEARING AND DENIAL OF REHEARING

THE COURT:

It is ordered that the opinion on rehearing filed April 19, 2005 (128 Cal.App.4th 676;___Cal.Rptr.3d___), be modified as follows:

On page 5 [128 Cal.App.4th 683, advance report], footnote 3, delete the last sentence which reads: "In these circumstances, the 1995 acknowledgements are tantamount to an admission that the victim suffered 'great bodily injury.' "

The petition for rehearing from opinion on rehearing is denied.

[No Change in Judgment.]

Gilbert, P.J., would grant the rehearing.
