People v. Tellier

Appellate Division of the Supreme Court of New York, First Department
May 8, 1956
1 A.D.2d 993 (N.Y. App. Div. 1956)

Opinion

May 8, 1956

We do not consider that the continuance of the temporary injunction was conditioned upon the case being tried on March 19th. The Attorney-General has proceeded diligently and expeditiously, and in the circumstances the injunction should not have been vacated. Order vacating the injunction unanimously reversed and the injunction reinstated.

Concur — Botein, J.P., Rabin, Cox, Frank and Valente, JJ.
