ORDER MODIFYING OPINION

THE COURT:

WILLHITE, Acting P. J., MANELLA, J., SUZUKAWA, J.

It is ordered that the opinion filed herein on September 26, 2007 be modified as follows:

1. On page 3, lines 9 and 10, delete the phrase “he acted as the lookout during the robbery, and that his accomplice” and replace it with:

another man

2. On page 3, line 14, after the sentence ending with “the attempted robbery,” insert the following sentence:

At the hearing on the motion, appellant admitted that he was present during the attempted robbery, but denied being the shooter.

There is no change in the judgment.
