Opinion

THE PEOPLE, Plaintiff and Respondent, v. MARISA BRAZIEL STOKES, Defendant and Appellant. C056280 California Court of Appeal, Third District, Tehama August 18, 2008

NOT TO BE PUBLISHED

Super. Ct. No. NCR69096

RAYE, J.

Between November 10, 2004, and November 13, 2004, defendant Marisa Braziel Stokes and her husband William Boyd Stokes went to the Rolling Hills Casino in Corning, where they put 12 bills altered to appear as $100 bills into slot machines. The machines accepted the bills as true, giving defendant and her husband credit for $1,200.

A jury convicted defendant of grand theft (Pen. Code, § 487, subd. (a)), second degree commercial burglary (Pen. Code, § 459), and forgery by alteration (Pen. Code, § 470, subd. (d)). Sentenced to state prison for an aggregate term of three years, defendant appeals.

We appointed counsel to represent defendant on appeal. Counsel filed an opening brief that sets forth the facts of the case and requests this court to review the record and determine whether there are any arguable issues on appeal. (People v. Wende (1979) 25 Cal.3d 436.) Defendant was advised by counsel of the right to file a supplemental brief within 30 days of the date of filing of the opening brief. More than 30 days elapsed, and we received no communication from defendant. Having undertaken an examination of the entire record, we find no arguable error that would result in a disposition more favorable to defendant.

DISPOSITION

The judgment is affirmed.

We concur: SCOTLAND, P.J., CANTIL-SAKAUYE, J.
