THE PEOPLE OF THE STATE OF NEW YORK, RESPONDENT, v. DARRYL STOKES, DEFENDANT-APPELLANT.


PRESENT:

Defendant having moved for an extension of time to file and serve an addendum to his motion seeking leave to appeal from the order of Supreme Court, Erie County, dated August 18, 2017,

Now upon reading and filing the affidavit of Darryl Stokes sworn to December 1, 2017, the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the Clerk of this Court is directed to accept the addendum submitted on December 7, 2017, and

It is further ORDERED that the motion seeking leave to appeal from the order of Supreme Court, Erie County, dated August 18, 2017 shall be returnable on January 29, 2018.
