Submitted February 20, 2002.

March 25, 2002.

Appeal by the defendant from a judgment of the County Court, Orange County (DeRosa, J.), rendered June 13, 2001, convicting him of criminal possession of a weapon in the third degree, upon his plea of guilty, and imposing sentence.

Dennis P. Portararo, Middletown, N.Y., for appellant.

Francis D. Phillips II, District Attorney, Goshen, N.Y. (Andrew R. Kass of counsel), for respondent.

Before: MYRIAM J. ALTMAN, J.P., NANCY E. SMITH, GABRIEL M. KRAUSMAN, LEO F. McGINITY, and BARRY A. COZIER, JJ.

ORDERED that the judgment is affirmed.

We have reviewed the record and agree with the defendant's assigned counsel that there are no nonfrivolous issues which could be raised on appeal. Counsel's application for leave to withdraw as counsel is granted (see, Anders v. California, 386 U.S. 738; People v. Paige, 54 A.D.2d 631; cf., People v. Gonzalez, 47 N.Y.2d 606).

ALTMAN, J.P., SMITH, KRAUSMAN, McGINITY and COZIER, JJ., concur.
