ORDER
Douglas B. Shapiro, Judge, acting under MCR 7.211(E)(2), orders:
The motion for immediate consideration is DENIED.
The motion for leave to file amended brief on appeal is GRANTED TO THE EXTENT that the appellant's brief filed on July 3, 2023, is considered as withdrawn. Appellant shall file an amended brief by January 31, 2024. The prosecution may file a responsive brief within 35 days of service of appellant's amended brief.
