On order of the Court, the delayed application for leave to appeal from the February 27, 2002 decision of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.

Kelly, J., would remand to the trial court for it to rule on the defendant's claim that his convictions violate his protection against double jeopardy.
