Petition for Leave to Appeal Denied.

In the exercise of this Court’s supervisory authority, the Appellate Court, Third District, is directed to vacate its judgment in People v. Smolley, case No. 3-19-0545 (05/04/22). The appellate court is directed to consider the effect of this Court’s opinion in People v. Hilliard, 2023 IL 128186, ¶ 29 on the issue of whether defendant may challenge his sentence under the proportionate penalties clause where the sentence is not a de facto life sentence and determine if a different result is warranted.

O’Brien, J. took no part.
