The order of the Court dated December 18, 2001, remanded this case to the Court of Appeals with instructions to issue a supplemental opinion clarifying the Court of Appeals' analysis of a constitutional harmless error issue. We retained jurisdiction over the defendant's delayed application for leave to appeal. The Court of Appeals issued its supplemental opinion on February 12, 2002.

On order of the Court, the defendant's delayed application for leave to appeal from the December 15, 2000 decision of the Court of Appeals, as supplemented by the February 12, 2002 decision of the Court of Appeals, is considered again and, it appearing to this Court that the case ofPeople v Katt (Docket No. 120515) is pending on appeal before this Court and that the decision in that case may resolve an issue raised in the present application for leave to appeal, we ORDER that the application be held in ABEYANCE pending the decision in that case.
