Jul 26, 2012
2012 N.Y. Slip Op. 80008 (N.Y. App. Div. 2012)

Opinion

Motion No: 103485

07-26-2012

THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. NAQUAN T. SMALL, Appellant.

DECISION AND ORDER ON MOTION

By order dated January 31, 2012, assigned counsel, Michael W. Brosnan, Esq., was granted an extension of time to perfect this appeal until March 5, 2012. The order noted that no further extensions would be granted absent an unanticipated excuse for the delay. Mr. Brosnan has failed to perfect the appeal or seek a further extension of time to do so.

Now, therefore, upon the Court's own motion, it is

ORDERED that in the event the appeal is not perfected on or before August 27, 2012, Michael W. Brosnan, Esq., shall be relieved from his assignment and new counsel assigned.

PETERS, P.J., MERCURE, MALONE JR., STEIN and GARRY, JJ., concur.
