DECISION & ORDER ON MOTION
Motion by the appellant, in effect, for leave to reargue the appellant's prior motion to recall and vacate an order on application of this Court dated August 17, 2010, which granted his application to withdraw an appeal from a judgment of the County Court, Nassau County, rendered September 22, 2008, and to reinstate the appeal, which was determined by decision and order on motion of this Court dated September 21, 2012.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
