DECISION & ORDER ON MOTION

Motion by appellant, for permission to file an abridged record on an appeal from an order the District Court of Suffolk County, First District, rendered May 26, 2021.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted.

In support of the motion, appellant avers that the order being appealed is based solely upon the District Court's interpretation of the new procedural provision under CPL § 30.30 (5-a). Under the circumstances, and in the absence of opposition, the motion is granted (see 22 NYCRR 731.9 [b] [2]).
